Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using CapitolPulse.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and My Media Matters ("Company," "we," "us," or "our").
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
Description of Service
CapitolPulse.ai is a legislative tracking and civic engagement platform that:
- Tracks state and federal legislation
- Provides AI-powered bill scoring and analysis
- Enables organizations to share legislative information with their communities
- Facilitates citizen feedback on legislation
- Delivers notifications via email and SMS
The Service is provided for informational purposes only. While we strive for accuracy, we do not guarantee that legislative information is complete, current, or error-free. Always verify important legislative information through official government sources.
3. Account Registration
To access certain features, you must create an account. You must be at least 13 years old. If under 18, you represent you have parental permission. You are responsible for maintaining account security and all activity under your account. Providing a false address to misrepresent your legislative district is a violation of these Terms.
4. Address Verification
When you submit your address, we use geocoding services to confirm it is valid within a legislative district. If confirmed, your account receives "Verified Constituent" status.
Important: "Verified Constituent" status confirms you submitted a valid address. It does not verify your identity, confirm residency, establish voter registration, or constitute legal proof of domicile. You agree not to submit an address that is not your own.
5. Feedback Submissions
When you express support or opposition through the Service, your position is recorded in your account and may be included in aggregate analytics for organizations.
Feedback is not official government communication. Expressing support or opposition through Capitol Pulse does not constitute testimony or communication to any government body unless explicitly stated. Submit official comments through appropriate government channels (e.g., regulations.gov).
We do not guarantee your feedback will be delivered to, read by, or acted upon by any legislator or official.
6. AI-Generated Content
The Service uses AI to generate bill summaries, relevance scores, regulatory analysis, and FOIA guidance.
AI content is for informational purposes only. It is not legal advice. Summaries may contain errors or mischaracterizations. We do not warrant accuracy. Always consult official sources (Congress.gov, regulations.gov, etc.) for authoritative text. Decisions based on AI content are your responsibility.
Subscription and Payment
Some features of the Service require a paid subscription:
- Billing: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.
- Free Trial: New accounts may be eligible for a free trial period. At the end of the trial, you will be charged unless you cancel.
- Automatic Renewal: Subscriptions automatically renew unless you cancel before the renewal date.
- Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
- Refunds: Subscription fees are non-refundable, except as required by law or at our sole discretion.
- Price Changes: We may change our subscription prices with 30 days' notice. Price changes take effect at the next billing cycle.
SMS/Text Messaging Terms
By opting in to receive SMS messages from CapitolPulse.ai, you agree to the following:
- Consent: You consent to receive automated SMS messages from CapitolPulse.ai at the phone number you provide. This consent is not required as a condition of purchase.
- Message Types: Messages may include legislative alerts, bill status updates, account notifications, and service announcements.
- Frequency: Message frequency varies based on legislative activity. During active sessions, you may receive several messages per week.
- Costs: Message and data rates may apply. CapitolPulse.ai does not charge for SMS messages, but your carrier may.
- Opt-Out: Reply STOP at any time to stop receiving SMS messages. You will receive a confirmation message. You may also opt out through your account settings.
- Help: Reply HELP for assistance, or email [email protected].
- Carriers: SMS service is available on most major U.S. carriers. Carriers are not responsible for delayed or undelivered messages.
By providing your phone number and opting in, you confirm that you are the account holder or have authorization to use the phone number provided.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use automated scripts, bots, or scrapers without authorization
- Transmit viruses, malware, or other harmful code
- Harass, abuse, or harm other users
- Submit content that is defamatory, obscene, or violates others' rights
- Circumvent any security or access controls
User Content
You may submit content to the Service, including feedback on legislation and comments. By submitting content:
- You retain ownership of your content
- You grant us a non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service
- You represent that you have the right to submit the content and that it does not violate any third-party rights
- Organizations that receive your feedback may use it for their legitimate purposes
We reserve the right to remove content that violates these Terms or that we find objectionable, without notice.
Intellectual Property
The Service, including its design, features, content, and underlying technology, is owned by My Media Matters, LLC and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. You may not reverse engineer or attempt to extract the source code of the Service.
"Capitol Pulse" and the CapitolPulse.ai logo are trademarks of My Media Matters, LLC. You may not use these marks without our prior written permission.
Third-Party Services
The Service may integrate with or contain links to third-party services, including:
- LegiScan for legislative data
- Stripe for payment processing
- Twilio for SMS messaging
- Geocodio for address verification
- OpenAI for AI-powered bill analysis
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure; that defects will be corrected; or that the Service is free of viruses or other harmful components.
Legislative information provided through the Service is for informational purposes only and should not be relied upon as legal advice. Always consult official government sources and qualified professionals for important legislative matters.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY MEDIA MATTERS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless My Media Matters, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit through the Service
Termination
We may terminate or suspend your access to the Service at any time, with or without cause or notice. Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and associated data
- Provisions that by their nature should survive termination will survive
You may terminate your account at any time through your account settings or by contacting us.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Oklahoma, except that either party may seek injunctive relief in any court of competent jurisdiction.
You agree to resolve disputes with us individually and waive any right to participate in a class action lawsuit or class-wide arbitration.
General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
